Terms of Service

These Terms of Service ("Terms") govern your access to and use of PromptCreek, operated by ZANUBIO SRL ("we", "us", or "our") at https://www.promptcreek.com. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using PromptCreek, you confirm that you are at least 16 years of age and agree to comply with these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our services.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

3. User Content

"User Content" refers to any prompts, reviews, comments, or other materials you submit to PromptCreek.

  • Ownership: You retain ownership of your User Content. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and make your content available on the platform.
  • Responsibility: You are solely responsible for your User Content and represent that you have all necessary rights to submit it.
  • Removal: You may delete your content at any time. We may also remove content that violates these Terms.

4. Acceptable Use

You agree not to:

  • Submit content that is illegal, harmful, threatening, abusive, or violates others' rights
  • Submit content that infringes on any intellectual property or proprietary rights
  • Attempt to gain unauthorized access to our systems, networks, or other user accounts
  • Use our services for spam, phishing, or distributing malware
  • Scrape, crawl, or use automated tools to access the platform beyond normal use
  • Circumvent, disable, or interfere with any security features
  • Impersonate any person or entity, or misrepresent your affiliation
  • Violate any applicable local, national, or international law or regulation

5. Payments and Subscriptions

  • Paid features are billed through Stripe. By subscribing, you agree to Stripe's Terms of Service.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • Refunds are handled on a case-by-case basis. Contact us at hello@promptcreek.com for refund requests.
  • We reserve the right to change pricing with reasonable notice. Existing subscribers will be notified before any price changes take effect on their next renewal.

6. Intellectual Property

The PromptCreek service, including its design, code, logos, trademarks, and original content, is owned by ZANUBIO SRL and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without prior written consent.

7. Privacy

Your use of PromptCreek is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect your personal data.

8. Disclaimers

  • PromptCreek is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee that the service will be uninterrupted, error-free, or secure at all times.
  • We are not responsible for the accuracy, quality, or reliability of any User Content or AI-generated prompts shared on the platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ZANUBIO SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use our services.

Our total liability for any claims arising from these Terms or your use of the service is limited to the amount you paid to us in the 12 months preceding the claim, or EUR 100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless ZANUBIO SRL from any claims, damages, or expenses arising from your violation of these Terms, your User Content, or your use of the service in a manner not authorized by these Terms.

11. Termination

  • You may terminate your account at any time by contacting us or using the account deletion feature.
  • We may suspend or terminate your account at any time for violations of these Terms, with or without notice.
  • Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination will survive (e.g., intellectual property, limitation of liability, indemnification).

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and notify users through the platform or via email. Continued use of the service after changes constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Romania.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
