Terms of Service

These Terms of Service ("Terms") govern your access to and use of PromptCreek, operated by ZANUBIO SRL ("we", "us", or "our") at https://www.promptcreek.com. By creating an account or using the service, you agree to these Terms.

Two related documents form part of these Terms: our Acceptable Use Policy, which defines what you may and may not publish, and our Refund & Cancellation Policy, which sets out your cancellation and withdrawal rights.

2. Eligibility and accounts

  • You must be at least 16 years old to create an account.
  • You must provide accurate information and keep your account credentials confidential.
  • You are responsible for everything that happens under your account.
  • One person may not maintain multiple accounts to obtain additional free credits or challenge rewards.
  • You can sign in with an email and password, a magic link sent to your email, or your Google account. If you use Google, your access is also subject to Google's own terms.

3. Your content and the licence you give us

"Your Content" means any prompt, title, description, instructions, review, rating, profile information, image, or other material you submit to PromptCreek, including prompts produced for you by the Prompt Enhancer.

  • You keep ownership. These Terms do not transfer ownership of Your Content to us.
  • Licence. For Your Content that is public on the platform, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, distribute, translate, and publicly perform it in order to operate, promote, and improve PromptCreek. This includes showing your prompt in browse listings, category, tag, model and bundle pages, search results, our blog, newsletters, and social posts.
  • Editorial changes. We may edit the title, description, tags, category, formatting, or metadata of a public prompt for clarity, accuracy, or search visibility, and we may promote a public prompt into our curated listings and submit it to search engines. We will not misattribute your prompt to someone else.
  • Attribution. Public prompts and reviews are displayed alongside the display name on your account. Choose a display name you are comfortable publishing.
  • Your promises. You confirm you have the rights necessary to submit Your Content and to grant this licence, and that Your Content does not infringe anyone else's rights or break the law.
  • Ending the licence. Deleting a prompt ends the licence going forward. Copies already made by other users, search engines, or caches are outside our control, and we may retain backup copies for a limited period.

4. Prompt visibility — public by default, private as a paid feature

Please read this section carefully; it determines who can see what you create.

  • Free accounts publish. If you are on the Free plan, prompts you generate with the Prompt Enhancer are published to the public community library as soon as they are created. They get a public URL, they are visible to anyone on the internet, and they are attributed to your display name.
  • Paid plans keep prompts private. On a paid plan, prompts you generate are private to your account unless you choose to publish them. Keeping prompts private is a paid entitlement.
  • Existing private prompts stay private. If your subscription ends, prompts that were already private remain private and remain accessible to you. You will not be able to make further prompts private until you subscribe again.
  • Publishing is one-directional in practice. Once a prompt has been public, assume it has been seen, copied, and indexed. Making it private later does not undo that.
  • Do not put confidential information in prompts you publish. Never include personal data about other people, credentials, API keys, client information, or trade secrets in a prompt that will be public.
  • Curation is ours. Being public does not guarantee placement. We decide which prompts appear in curated browse listings and which are submitted to search engines.

5. Credits

The Prompt Enhancer runs on credits. Credits are a licence to use a feature, not money, and hold no cash value.

  • Three kinds. Plan credits come with a subscription or the free monthly grant. Top-up credits are bought in packs. Earned credits come from community challenges.
  • Plan credits reset. Your monthly plan allowance resets at each renewal and does not roll over. Unused plan credits are lost at reset.
  • Top-up and earned credits do not expire while your account is open, and they survive a plan reset.
  • Spending order. Plan credits are spent first, then earned credits, then top-up credits.
  • Failures are refunded in credits. If a generation fails on our side, the credits are returned to the pools they came from. A result you simply dislike is a delivered result and is not refunded.
  • Not transferable. Credits and MEGA Passes cannot be sold, transferred, or exchanged for cash, and are forfeited when an account is closed.
  • We may change costs. The credit cost of a feature can change as underlying model costs change. Material increases will be announced in advance.

6. Community challenges

  • Challenges award credits and MEGA Passes for genuine contributions such as reviews and public generations.
  • Rewards are discretionary and we may add, change, or retire challenges at any time. Retiring a challenge does not take back rewards already granted.
  • Gaming the system — low-effort or duplicate reviews, automated submissions, multiple accounts, or content created only to trigger a reward — voids the rewards. We may reverse credits obtained this way and suspend the account.
  • Challenge rewards have no cash value and are not purchasable.

7. Subscriptions, payments and pricing

  • Payments are processed by Stripe. We never receive your full card number. Your payment is also subject to Stripe's terms.
  • Subscriptions renew automatically for the same period until cancelled. You can cancel at any time from your billing settings; access continues until the end of the paid period.
  • Credit packs are one-off purchases, charged once, and are not subscriptions.
  • Prices are shown in euro (EUR) and the amount displayed at checkout is the amount charged. ZANUBIO SRL is not registered as a VAT payer in Romania and applies the special exemption scheme for small enterprises, so no Romanian VAT is added to your purchase. Our intra-community VAT code above is used for cross-border transactions and does not mean VAT is charged on these prices.
  • We may change prices. Existing subscribers will be notified before a new price applies to a renewal, and may cancel before it takes effect.
  • Failed payments may result in the loss of paid features until payment succeeds. Your existing private prompts stay private and accessible to you.
  • Cancellation, refunds, and your statutory right of withdrawal are covered in the Refund & Cancellation Policy.

8. Acceptable use

Our Acceptable Use Policy lists in detail what may not be published or done on PromptCreek. In summary, you agree not to:

  • Publish content that is illegal, hateful, harassing, sexually exploitative, or that endangers minors
  • Publish content that infringes copyright, trademarks, privacy, or other rights
  • Publish prompts designed to produce malware, fraud, or targeted harm to a real person
  • Include other people's personal data or your own secrets and credentials in public content
  • Spam the library, farm challenge rewards, or manipulate ratings
  • Attempt to access accounts, systems, or data you are not authorised to access
  • Scrape or bulk-extract the library, or use automated tooling beyond normal use of the site and API
  • Resell, sublicense, or redistribute the prompt library as a competing product or dataset
  • Circumvent credit limits, paywalls, rate limits, or security features

9. Moderation, removal, and enforcement

PromptCreek hosts content submitted by its users. We do not review everything before it is published, and publication is not an endorsement.

  • We reserve the right to remove content. Where we consider content to be illegal, deceptive, inappropriate, unsafe, spam, infringing, or otherwise in breach of these Terms or the Acceptable Use Policy, we may remove it, unpublish it, make it private, de-index it from search engines, or edit it, at our discretion and without prior notice.
  • We may act on accounts. We may issue a warning, restrict features, suspend, ban, or terminate an account that repeatedly or seriously breaches these Terms.
  • Reporting. Every prompt page has a "Report prompt" link that opens an email to us with the prompt already identified. Tell us what is wrong — spam, inappropriate content, harassment, copyright, or anything else — and a person will review it.
  • Notice of decisions. Where we remove your content or restrict your account, we will tell you the main reason at the email address on your account, unless we are legally prevented from doing so or the account was created for abuse.
  • Disagree with a decision? Reply to that notice, or write to hello@promptcreek.com within 30 days. A person will review it and respond. If we got it wrong, we will restore the content or the account.
  • Bad-faith reports. Repeatedly filing reports you know to be unfounded is itself a breach of these Terms.

10. Copyright complaints and takedown

If you believe content on PromptCreek infringes your copyright, email hello@promptcreek.com with the subject "Copyright notice" and include:

  • The URL of the content in question
  • A description of the work you say it infringes, and proof you own or represent the owner of that work
  • Your name, address, and contact email
  • A statement that you believe in good faith that the use is not authorised, and that your notice is accurate

We will review and, where the notice is valid, remove or disable access to the content and notify the person who posted it. That person may send a counter-notice to the same address explaining why the content should be restored; if they do, we may restore it. Accounts that repeatedly infringe will be terminated.

11. AI features and third-party models

  • The Prompt Enhancer and other AI features send the text you submit to third-party AI providers through OpenRouter, which routes it to the model that produces your result. See the Privacy Policy for what that means for your data.
  • AI output is generated automatically. It may be inaccurate, biased, or unsuitable for your purpose, and similar inputs may produce similar outputs for different users. Check anything important before relying on it.
  • You are responsible for how you use AI output, including compliance with the terms of whichever AI tool you paste it into.
  • Parts of our library and blog are AI-assisted and reviewed by us before publication. We do not warrant that any prompt achieves a particular result.
  • The "Open in" feature copies a prompt and opens a third-party AI service. Those services are operated by other companies under their own terms and privacy policies.

12. Our intellectual property

The PromptCreek service — its design, code, logos, trademarks, curated collections, and original editorial content — belongs to ZANUBIO SRL and is protected by intellectual property law. You may use prompts from the library for your own personal or business purposes. You may not copy the platform itself, redistribute the library as a dataset or competing product, or use our branding without written permission.

13. Service availability and changes

  • We may add, change, or remove features. If we remove a feature that is material to a paid plan, you may cancel and we will refund the unused portion of your current period.
  • The service is provided on an "as is" and "as available" basis. We do not promise it will be uninterrupted, error-free, or free of data loss, and we do not guarantee any particular uptime.
  • Keep your own copies of prompts that matter to you.

14. Liability

Nothing in these Terms limits liability that cannot be limited by law. In particular, we do not exclude liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional misconduct or gross negligence, or for any statutory rights you have as a consumer.

Subject to that, to the maximum extent permitted by law ZANUBIO SRL is not liable for indirect, incidental, special, or consequential damage, or for loss of profit, revenue, data, or goodwill, arising from your use of or inability to use the service; and our total liability for all claims in any twelve-month period is limited to the greater of the amount you paid us in that period and EUR 100.

If you are a consumer in the EU, these limits apply only to the extent your national law allows, and your mandatory rights are unaffected.

15. Indemnity

If you use the service in a business capacity, you agree to indemnify ZANUBIO SRL against claims, damages, and reasonable costs arising from Your Content, your breach of these Terms, or your unlawful use of the service. This does not apply to consumers.

16. Closing your account

  • You can close your account at any time by emailing hello@promptcreek.com from the address on your account. We will confirm and delete it, along with your prompts, reviews and credit balance, within 30 days.
  • Cancel any active subscription first; closing an account does not by itself stop billing.
  • Public prompts you have published may be retained in anonymised form where other users depend on them, unless you ask us to remove them.
  • We may suspend or terminate an account for breach of these Terms, or on 30 days' notice if we discontinue the service. If we discontinue the service, we will refund the unused portion of any paid period.
  • Sections that by their nature should survive termination do so, including the content licence for material that remains public, intellectual property, liability, and governing law.

17. Changes to these Terms

We may update these Terms. For material changes we will update the "Last updated" date and notify you in the app or by email at least 14 days before they take effect, unless a change is required sooner by law. If you do not accept a change, you may close your account before it takes effect; continued use afterwards means you accept it.

18. Governing law and disputes

These Terms are governed by Romanian law. If you are a consumer resident in the EU, you also keep the protection of the mandatory rules of your own country, and you may bring proceedings in the courts there; we will bring any claim against you in the courts of your country of residence. For everyone else, the courts of Romania have exclusive jurisdiction.

Please contact us first at hello@promptcreek.com — most problems are settled that way. EU consumers may also use the European Commission's Online Dispute Resolution platform. We are not obliged to participate in alternative dispute resolution before a consumer arbitration body.

19. General

  • If any provision is found invalid, the rest stays in force and the invalid provision applies to the maximum extent permitted.
  • Not enforcing a right on one occasion does not waive it.
  • You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a reorganisation or sale of the business, without reducing your rights.
  • These Terms, together with the Acceptable Use Policy, Refund & Cancellation Policy, Privacy Policy, and Cookie Policy, form the entire agreement between us.

20. Contact
